Abstract
U radu se obrađuje uloga policije u kaznenom postupku u širem smislu osobito u stadiju izvida, a prije pokretanja formalnog kaznenog postupka u kojem stadiju je policija možda i najbitnije tijelo uz državnog odvjetnika. Nadalje se opisuje policijsko ustrojstvo, poslovi, ovlasti, temeljna načela rada, uloga policijskog istražitelja te objašnjenje i podjelu izvida kaznenih djela. Prikazan je također povijesni pregled razvoja pravnog uređenja uloge policije u prethodnom postupku u Republici Hrvatskoj koji se razvoj temeljio na čestim izmjenama i dopunama Zakona o kaznenom postupku. Poseban naglasak stavlja se i na radnju ispitivanja osumnjičenika od strane policije koja radnja označava relativnu novost u postupanju policije, a koja radnja ukoliko je od policijskog službenika poduzeta na zakonit način može predstavljati dokaz u kaznenom postupku.
Abstract (english)
In this paper it is shown the role of the police in criminal pre-trial and trial which is possibly having the most imporant role besides the state attorney, and speciffically, the organization, affairs, authority, basic work principles and the role of the police investigator and explanation and organization of inquest of criminal acts. Also, historical overview of the development of criminal pre-trial in Republic of Croatia which was based on frequent changes and additions to Crimanal Procedure Law. Special emphasis is as well placed on interrogation of a suspect from the side of the police which is a relatively new affair in police actions, but if it is conducted in a lawful way it can be used as an evidence in a criminal trial.
