Abstract
U ovom diplomskom radu razrađuje se tema Ustavnog prava na zaštitu osobnih podataka. Temelj ustavnopravno zaštite osobnih podataka nalazi se u čl.37. Ustava RH. Međutim, Ustav RH nije jedini zakonodavni dokument implementiran u zakonodavstvo RH koji predviđa zaštitu osobnih podataka. Ulaskom RH u EU pravni poredak se ojačava i nadopunjuje pravnom stečevinom EU, a među kojom je i niz dokumenata koje sadrže odredbe o zaštiti osobnih podataka. Cilj ovoga rada je prikazati razvoj prava na zaštitu... More osobnih podataka odnosno genezu tog prava kroz povijesne pravne akte, zatim prikazati pozitivno-pravne akte koji predviđaju pravo na zaštitu osobnih podataka. Nadalje se prikazuje rad neovisnih nadzornih tijela za zaštitu podataka u državama EU, sa posebnim osvrtom na djelovanje Agencije za zaštitu osobnih podataka u RH te pravo na pravni lijek, naknadu štete i odgovornost zbog povrede prava na zaštitu osobnih podataka. Završno poglavlje je posvećeno sudskoj praksi Europskog suda za ljudska prava, Suda EU u Luxembourgu te Ustavnog Suda RH. Rad završava zaključkom o izloženoj temi. Less
Abstract (english)
This thesis elaborates the topic of the Constitutional right to protection of personal data. The basis of constitutional protection of personal data is found in Article 37 of Constitution of the Republic of Croatia. However, the Constitution of the Republic of Croatia is not the only legislative document implemented in the legislation of the Republic of Croatia that provides for the protection of personal data. With the accession of the Republic of Croatia to the EU, the legal order is... More strengthened and supplemented by the acquis of the EU, among which are a number of documents containing provisions on the protection of personal data. The aim of this work is to show the development of the right to the protection of personal data, that is, the genesis of that right through historical legal acts, then to present the positive legal acts that foresee the right to the protection of personal data. Further in the work, functioning of independent supervisory authorities for data protection with an introduction to the chapter that highlights the development of similar authorities in other EU countries is presented. The rest of the mentioned chapter is devoted to the work of the Croatian Agency for the Protection of Personal Data, the right to a legal remedy, compensation for damages and responsibility for the violation of the right to the protection of personal data. The final chapter is devoted to the case law of the European Court of Human Rights, the EU Court in Luxembourg and the Constitutional Court of the Republic of Croatia.
