Abstract
U ovom radu analiziran je institut zabilježbe u novom Zakonu o zemljišnim knjigama. Sadržaj rada je uvod u zemljišnoknjižno pravo uopće, vrste upisa u zemljišnu knjigu, analiza instituta zabilježbe te promjene kod instituta zabilježbe u novom Zakonu. Prije svega, za razumijevanje pravnih učinaka upisa u zemljišnu knjigu, prethodno treba poznavati načela zemljišnoknjižnog prava. Stoga su u radu prvo definirana pravila i načela zemljišnoknjižnog prava na kojima je zasnovan čitav institut zemljišne knjige. Kratko je analiziran institut zemljišne knjige, objašnjene su funkcije i osnovna obilježja zemljišnih knjiga te je definiran sastav zemljišnih knjiga. Također su definirane sve tri vrste upisa u zemljišne knjige. U radu su prikazane novote kod instituta zabilježbe u novom Zakonu o zemljišnim knjigama uspoređujući zabilježbe s obzirom na stari Zakon o zemljišnim knjigama. Metode korištene prilikom pisanja ovog rada su: metode analize i sinteze, te metode induktivnog i deduktivnog zaključivanja.
Abstract (english)
In this paper, we have analyzed the institute of recordation in new land registration act. Content of the paper includes introduction to land-registry law in general, land register entries, analysis of institute of recordation and changes in the institut of recordations in new land-registry law. Above all, for understanding the legal effects of land register entries, one must first know the principles of land-registry law. So, firstly in this paper we have defined the rules and the principles of land-registry law on which is based the whole institut of land register. We briefly analyzed the institute od land register, functions and basic features of land register are explained and composition of land register is defined. All three land register entries are also defined. The paper, also, explains the changes in the institute of recordation in new land-registry law comparing recordation with old land-registry law. Methods which were used in the process of writing this paper are: analysis and synthesis method and method of inductive and deductive reasoning.
