Abstract
Ravnopravnost spolova u uvjetima u osiguranju relativno je nov pojam kojeg je uvelo „zakonodavstvo“ Europske unije. Svojim uvođenjem putem Direktive 2004/113/EZ izazvalo je brojne polemike i sporne situacije te potaklo pitanja država i pojedinaca o primjeni istog. Direktivom su ipak dopuštene određene iznimke, koje su osiguravatelji koristili kao opravdanje u razlici premija između muškaraca i žena sve do intervencije Europskog suda pravde. U radu će se analizirati pojam spolne ravnopravnosti kao jedno od temeljnih vrijednosti europskog pravnog poretka s naglaskom na industriju osiguranja. Nadalje, prikazat će se razvojni put od spomenute Direktive, Smjernica za njenu provedbu, Test Achats, na području Europske unije sa posebnim osvrtom na Republiku Hrvatsku.
Abstract (english)
Gender equality in insurance conditions is a relatively new concept introduced by European Union "legislation." Its introduction through Directive 2004/113/EC has sparked numerous debates and contentious situations, raising questions among states and individuals about its implementation. However, the Directive allows for certain exceptions, which insurers used to justify the difference in premiums between men and women until the intervention of the European Court of Justice. In this paper, the author will analyze the concept of gender equality as one of the fundamental values of the European legal order, with an emphasis on the insurance industry. Furthermore, the development path from the aforementioned Directive, the Guidelines for its implementation, the Test Achats case to the present day in the European Union, with a special focus on the Republic of Croatia, will be presented.
