Abstract
Istražni zatvor predstavlja najtežu kazneno-procesnu mjeru koja zadire u osnovno ljudsko pravopravo na slobodu. Međutim, istražni zatvor nije kaznenopravna sankcija za okrivljenika već mjera kojom se žele postići određeni ciljevi. ZKP vrlo detaljno uređuje nadležnost i uvjete određivanja i provođenja institut istražnog zatvora, s obzirom da se tu radi o oduzimanju osobne slobode osobi koja se još uvijek smatra nedužnom.
Abstract (english)
Investigation prison or pre-trial detention is the most severe criminal measure that denies the basic human right- the right to be free- freedom. However, pre- trial detention is not a criminal sanction for the defendant but a mesure aimed at achieving certain goals. The law of criminal procedure in great detail regulates the jurisdiction and conditions for ordering and conducting pre-trial detention, given that it is a matter of depriving an indivdual who is still considered innocentof his personal liberty.
