Abstract
Cilj rada je analizirati položaj žene u srednjovjekovnoj Trogirskoj komuni. U uvodnom dijelu rada pojašnjeni su temeljni pojmovi kao što je statut i komuna, kratko je posvećena pozornost povijesti Trogira kao i vanjskopolitičkim i unutrašnjopolitičkim razlozima donošenja statuta. Pojašnjena je struktura samog Statuta, organizacija vlasti, i postupak donošenja zakona. U središnjem dijelu rada obrađena su pitanja pravnog položaja žene u obiteljskom, obveznom, nasljednom, kaznenom i procesnom pravu. Temeljni uzrok podređenog položaja žene jest sprječavanje diobe obiteljske imovine putem miraza. Podređeni položaj žene i djece u odnosu na očinsku figuru najviše se ističe u obiteljskom pravu, a do postupnog poboljšanja položaja žena dolazi zbog ekonomskog razvoja, koji traži novu i jeftiniju radnu snagu. Interakcijom pravnih kultura te prilagođavanjem raznih utjecaja poput mletačkog, rimskog, slavenskog i drugih, stvoren je komunalni statut. Upravo na toj raznolikosti i stapanju pravnih kultura počiva civilizacijska vrijednost statuta grada Trogira.
Abstract (english)
The introductory part of this research clarifies the concepts such as the statute and the commune and it gives a short review of the history of Trogir.It also explains the foreign and domestic political reasons for adopting the statutes. This research explains how the statue was structured, how the government was organized and how the laws were passed. The central part of the research addresses the status of women in family, compulsory, hereditary, criminal and procedural law. The fundamental reason for women’s inferior position in society was to prevent the division of family property through dowry. This subordinate position of women and children, compared to men’s position, can best be seen in the family law. The gradual improvement of the position of women came due to the economic development, which was looking for a new and cheaper workforce. Communal statue came to be through the interaction of legal cultures and the adapting of the variety of foreign influences such as Venetian, Roman, Slavic and others. It is precisely on this diversity and fusion of legal cultures that the civilisational value of the statute of the city of Trogir rests.
