Abstract
Tema ovog rada je prekovremeni rad i njegovo pravno uređenje. U suvremenim uvjetima rada u Republici Hrvatskoj, gdje se raspravlja kako se puno radno vrijeme radnika zbog svoje dužine treba skratiti, poseban problem predstavlja prekovremeni rad koji samo povećava dužinu radnog vremena. Cilj ovog rada je ispitati kada se prekovremeni rad može naložiti, koje se pretpostavke moraju ispuniti i koja ograničenja treba poštivati. Istraživanjem sudske prakse došlo se do zaključka da u Republici Hrvatskoj ima velik broj presuda s predmetom prekovremenog rada zbog raznih nepoštivanja zakona – neisplaćivanje prekovremenog rada, uvođenje prekovremenog rada kada za to ne postoji potreba ili neopravdano odbijanje naloženog prekovremenog rada.
Abstract (english)
This paper will cover overtime labour and the way it's been legally set up. In the Republic of Croatian and it's modern conditions, while one of topic being discussed is shortening the length of full working hours, special problem becomes overtime labour which only increases working hours. The objective is to examine at what occasions is appropriate to request overtime and what limitations should be respected. By examining court practice it became obvious that overtime was a part a lot of a judicial verdicts due to various violations of the law such as not paying overtime, putting in overtime when there isn't an actual need for it or refusing to fulfill overtime requests.
