Abstract
Ugovori su sastavni dio svakog poslovanja, pa tako i trgovačke razmjene. Slijedom navedenog važno je istaknuti kako je ugovor iskaz ugovornih strana o sklapanju i pravnom obvezivanju o ugovornim obvezama. Drugim riječima, ugovor je pravni posao zaključen suglasnim očitovanjem volja dviju ili više osoba usmjerenim na proizvođenje pravom dopuštenih pravnih učinaka koji se sastoje u postanku, prestanku ili promjeni pravnih odnosa. Predmet ovog diplomskog rada je ugovor o trgovačkoj kupoprodaji, odnosno analizirana je važnost ugovora o trgovačkoj kupoprodaji, pravna osnova te prava i obveze koje moraju poštivati ugovorne strane.
Abstract (english)
Contracts are an integral part of every business, including commercial exchanges. Following the above, it is important to point out that the contract is a statement of the contracting parties on the conclusion and legal commitment of contractual obligations. In other words, a contract is a legal transaction concluded by the unanimous expression of the will of two or more persons aimed at producing legal effects permitted by law, which consist in the creation, termination or change of legal relations. The subject of this thesis is a commercial sales contract, i.e. the importance of a commercial sales contract, the legal basis and the rights and obligations that must be respected by the contracting parties are analyzed.
