Abstract
Radni sporovi su sporovi između radnika i poslodavca, ili njihovih organizacija, koji nastaju u vezi s određenim radnim odnosom. Postupak u sporovima iz radnih odnosa uređen je kao posebni postupak Zakonom o parničnom postupku1(dalje: ZPP). Posebne karakteristike postupka u parnicama iz radnih odnosa očituju se u predsudskom postupku ostvarivanja prava iz radnog odnosa i rokovima za traženje zaštite povrijeđenog prava pred sudom, naglašenoj hitnosti u postupanju i oficijelnim ovlastima suda. Cilj rada je prikazati postupak ostvarivanja zaštite prava koja za radnika proizlaze iz radnog odnosa. U radu su prikazani pravni režimi ostvarivanja pravne zaštite, privremene mjere i zakonsko uređenje revizijskog postupka kroz godine.
Abstract (english)
Labour disputes are disputes between worker and employee or their organizations, that arise in connection to a specific employment relationship. The procedure in labour disputes is regulated as a special procedure by the Civil Procedure Act. Special characteristics of the procedure in labour disputes are manifested in the pre-court procedure of exercising rights from the employment relationship and the deadlines for seeking protection of the violated right before court, emphasized urgency in the proceedings and the official powers of the court. The aim of the paper is to present the procedure for the protection of rights that arise for the worker from the employment relationship. The paper presents the legal regimes for the realization of legal protection, temporary measures and the audit procedure.
