Abstract
Ovim radom dan je cjelovit prikaz pravne regulacije obveznog osiguranja od automobilske odgovornosti, uz poseban naglasak na treće osobe u osiguranju od automobilske odgovornosti. Zakon o obveznim osiguranjima u prometu, na nacionalnoj razini, regulira obvezna osiguranja u prometu, kao i prava trećih osoba te mehanizme ostvarivanja zakonom zajamčenih prava trećih osoba. Analizirane odredbe nacionalnog zakonodavstva usklađene su sa zakonodavstvom Europske Unije koji u sedam direktiva regulira područje osiguranja od građanskopravne odgovornosti u pogledu upotrebe motornih vozila i izvršenje obveze osiguranja od takve odgovornosti. U skladu s tim, analizirati će se normativna regulacija prava trećih osoba u Republici Hrvatskoj te stavovi sudske prakse kako nacionalnih sudova, tako i Suda pravde Europske Unije.
Abstract (english)
This paper provides a comprehensive overview of legal regulation of mandatory automobile liability insurance, with special emphasis on third parties in automobile liability insurance. The Law on Compulsory Traffic Insurance, at the national level, regulates mandatory traffic insurance, as well as the rights of third parties and the mechanisms for exercising the legally guaranteed rights of third parties. The analyzed provisions of the national legislation are harmonized with the legislation of the European Union, which in seven directives regulates the field of civil liability insurance with regard to the use of motor vehicles and the enforcement of the obligation to insure against such liability. Accordingly, analysis of the legislative regulation of the rights of third parties in the Republic of Croatia will be presented, as well as an analysis of judicial practice of national courts and the Court of Justice of the European Union.
