Abstract
U radu se analiziraju instituti povezani s postupkom prema okrivljenicima s duševnim smetnjama koji predstavlja posebnu vrstu kaznenog postupka. Osobe s duševnim smetnjama su posebno senzibilna skupina u društvu te se prema njima treba odnositi s dostojanstvom kao i prema svim drugim pojedincima. Međunarodno i nacionalno zakonodavstvo predviđa formu postupka prema osobama koje su u stanju neubrojivosti počinile protupravno djelo. Okrivljenicima s duševnim smetnjama ne mogu biti izrečene kaznenopravne sankcije jer im nedostaje element krivnje da bi se ostavio formalni pojam kaznenog djela. U Republici Hrvatskoj položaj osoba s duševnim smetnjama reguliran je posebnim zakonom, a to je Zakon o zaštiti osoba s duševnim smetnjama. Kazneni zakon također regulira načelo krivnje odnosno ograničava njegov doseg formulacijom koja glasi da „nitko ne može biti kažnjen ako nije kriv za počinjeno kazneno djelo“. U slučaju kada se pojavi sumnja da je osoba ostvarila obilježja kaznenog djela u stanju neurojivosti primjent će se posebne odredbe Zakona o kaznenom postupku zato jer se u kaznenom postupku utvrđuje je li osoba bila u stanju neubrojivosti u trenutku ostvarenja obilježja kaznenog djela. U tom slučaju također se primjenjuju i odredbe posebnog Zakona o zaštiti osoba s duševnim smetnjama.
Abstract (english)
This paper analyzes the institutes related to the procedure towards defendants with mental disorders, which represents a special type of criminal procedure. People with mental disorders are a particularly sensitive group in society and should be treated with dignity like any other individuals. International and national legislation regulate specia type of procedure for persons who have committed an unlawful act while in a state of insanity. Defendants with mental disorders may be subject to appropriate measures because they lack the element of guilt required for the formal concept of a criminal offense. In the Republic of Croatia, the position of people with mental disorders is regulated by a special law, the Act on the Protection of Persons with Mental Disorders. The Criminal Code also regulates the principle of guilt and limits its scope with the formulation that "no one can be punished if they are not guilty of the committed criminal offense." In order to establish if the person with mental disorder has commited an unlawful act a special procedure in accordance with the Criminal Procedure Act has to be implemented and also provisions of the lex specialis the Act on the Protection of Persons with Mental Disorders.
