Abstract
Sklapanjem ugovora o radu poslodavac i radnik zasnivaju radni odnos. Jedna od važnijih podjela ugovora o radu je ona na neodređeno i određeno vrijeme. Rad na određeno vrijeme se smatra jednim od nestandardnih oblika rada. Povećanjem broja ugovora o radu na određeno vrijeme i radnih odnosa na određeno vrijeme na tržištu rada, stvorila se sve veća potreba za kvalitetnom zakonskom regulacijom navedenog instituta. Iz statističkih podataka je vidljiv porast zaposlenosti na određeno vrijeme posebice... More kod mladih i žena, te osoba koje prvi put ulaze na tržište rada. Također je vidljivo da su kroz povijest u situacijama nastupa gospodarske krize osobe zaposlene na određeno vrijeme prve ostajale bez zaposlenja. EU i RH nastoje regulirati rad na određeno i osigurati zaštitu radnika kroz pravne akte poput Direktive 1999/70/EZ i Zakona o radu, te nastoje kroz poticaje za zapošljavanje na neodređeno vrijeme smanjiti ugovaranje rada na određeno, a povećati ugovaranje rada na neodređeno vrijeme. Konačna svrha povećanja rada na neodređeno je pružanje veće sigurnosti radniku i olakšavanje pri ostvarivanju prava kao što su porodiljni dopust, otpremnina ili pak odobravanje kredita koji su se pokazali kao problematični za radnike pri zaposlenju kod nestandardnih oblika rada. Abstract (english)
By concluding an employment contract, the employer and employee establish an employment relationship. One of the most important divisions of employment contracts is that for a permanent period and for a temporary period. Fixed-term work is considered one of the non-standard forms of work. With the increase in the number of fixed-term employment contracts and fixed-term employment relationships on the labor market, there is an increasing need for high-quality legal regulation of the... More aforementioned institute. Statistical data show an increase in temporary employment, especially among young people and women, and people entering the labor market for the first time. It is also evident that throughout history, in situations of economic crisis, people employed for a certain period of time (Temporary) were the first to become unemployed. The EU and the Republic of Croatia strive to regulate fixed-term work and ensure the protection of workers through legal acts such as Directive 1999/70/EC and the Labor Law, and through incentives for permenent employment, they strive to reduce fixed-term work contracting and increase permanent work contracting. The ultimate purpose of increasing permanent work is to provide greater security to the worker and allevuate the realization of rights such as maternity leave, severance pay or the approval of loans that have proven to be problematic for workers employed in non-standard forms of work.
