Abstract
Predmet ovog rada je sustav besplatne pravne pomoći u Republici Hrvatskoj, pri čemu je posebna pozornost posvećena pravnim klinikama u svojstvu pružateljica primarne pravne pomoći. Besplatna pravna pomoć ključan je aspekt pravnog sustava demokratske države jer omogućava svim osobama pristup pravdi bez obzira na njihovu socijalno-ekonomsku situaciju. U prvom dijelu rada analiziraju se sustavi besplatne pravne pomoći izabranih europskih država uključujući i određene postjugoslavenske države. Središnji dio rada usmjeren je na analizu i razradu sustava besplatne pravne pomoći u Republici Hrvatskoj na način da se izlažu glavne razlike među vrstama besplatne pravne pomoći, oblici u kojima se pojedina vrsta pravne pomoći pruža, pružatelji i korisnici primarne i sekundarne pravne pomoći, načini financiranja pravne pomoći i nadzor nad njezinim pružanjem. U radu su sadržani i grafički prikazi relevantnih statističkih podataka o materiji koja je u radu obrađena. Potom autorica detaljno razrađuje ustrojstvo i način rada pravnih klinika, naglašavajući pozitivne učinke na studente koji sudjeluju u njihovom radu te važnost kliničkog pravnog obrazovanja.
Abstract (english)
The subject of this paper is the system of free legal aid in the Republic of Croatia with particular focus on legal clinics as providers of primary legal aid. Free legal aid is a key aspect of the legal system in a democratic country as it ensures access to justice for all individuals, regardless of their socio-economic situation. The first part of the paper analyzes the systems of free legal aid in selected European countries, including certain post-Yugoslav states. The central part of the paper is focused on the analysis and elaboration of the free legal aid system in the Republic of Croatia, presenting the main differences between the types of free legal aid, the forms in which each type of aid is provided, the providers and users of primary and secondary legal aid, the methods of financing legal aid and oversight over its delivery. The paper also includes graphical representations of relevant statistical data related to the subject matter. The author then elaborates on the structure and operation of legal clinics highlighting the positive effects on students who participate in their work and the importance of clinical legal education.
