Abstract Računalna revolucija, razvoj interneta i osobnih računala, te njihova dostupnost širem krugu ljudi je dovela do nastanka računalnog kriminaliteta. Ne postoji općeprihvaćena definicija računalnog kriminaliteta. Jedan od načina definiranja je prema tome je li računalo sredstvo uporabe ili cilj. Razlozi računalnih napada nisu nužno financije, nekad su to upozorenja građanima, poruke prijetnje, opstrukcije operativnog sustava jednog poduzeća itd. Posljedice računalnog kriminaliteta štete inovacijama, trgovini i globalnom ekonomskog rastu. Razna poduzeća provode edukacije zaposlenika, te izdvajaju ogromna financijska sredstva s ciljem prevencije računalnog kriminaliteta. S obzirom na globalni karakter, donošenju različitih mjera u svrhu zaštite od računalnog kriminaliteta nije se moglo pristupiti na nacionalnoj razini, nego samo na međunarodnoj. Donosi se Konvencija o kibernetičkom kriminalu, Vijeća Europe potpisana u Budimpešti 2001.g. Njen cilj je zaštiti društvo od kibernetičkog kriminala vođenjem zajedničke kaznene politike. Nastankom računalnog kriminala dolazi i do razvoja nove vrste kaznenih djela. Hrvatski Kazneni zakon je pri reguliranju kaznenih djela poštivao obveze utvrđene Konvencijom i Direktivom 2013/40/EU o napadima na informacijske sustave. Novina je Zakon o kibernetičkoj sigurnosti koji je stupio na snagu 15. veljače 2024. Riječ je o implementaciji direktive Network and Information Security (NIS)2 Europske unije. Cilj direktive NIS2 je osigurati jednaku razinu kibernetičke sigurnosti u svim državama članicama Unije.
Abstract (english) The computer revolution, the development of the Internet and personal computers, and their availability to a wider range of people has led to the emergence of computer crime. There is no universally accepted definition of cybercrime. One way to define it is according to whether the computer is a means of use or objective. The reasons for computer attacks are not necessarily finances, sometimes they are warnings to citizens, threat messages, obstructions to the operating system of a company, etc. The consequences of cybercrime harm innovation, trade and global economic growth. Various companies conduct employee training, and allocate huge financial resources with the aim of preventing cybercrime. Consideration its global character, the adoption of various measures for the purpose of protection against cybercrime could not be approached at the national level, but only at the international level. The Council of Europe's Convention on Cybercrime, signed in Budapest in 2001, is adopted, with the aim of protecting society from cybercrime by conducting a common criminal policy. With the emergence of cybercrime, there is also the development of a new type of crime. When regulating criminal acts, the Croatian Criminal Code complied with the obligations set out in the Convention and Directive 2013/40/EU on Attacks on Information Systems. The novelty is the Law on Cybersecurity, which entered into force on February 15, 2024. It is about the implementation of the Network and Information Security (NIS)2 directive of the European Union. The goal of the NIS2 directive is to ensure an equal level of cyber security in all EU member states.
