This paper deals with the topic of prosecutors in criminal proceedings. Criminal proceedings are conducted at the request of an authorized prosecutor: the public prosecutor, a private prosecutor or a subsidiary prosecutor. The plaintiff is a procedural subject and, along with the defendant, is one of the parties in the criminal proceedings. The authorized prosecutor performs the function of criminal prosecution as he gives the initiative to initiate criminal proceedings, and then further conducts prosecution during the proceedings. The burden of proof is on the prosecutor in the process of establishing the guilt of a suspect, defendant or accused. For criminal offenses for which criminal proceedings are initiated ex officio, the prosecutor is the state attorney, while a private prosecutor is an authorized prosecutor for criminal offenses for which criminal proceedings are instituted on the basis of a private lawsuit. There are also some criminal offenses for which the law prescribes that the state attorney initiates only at the suggestion of the victim. If the State Attorney finds that there are no grounds for initiating or conducting criminal prosecution, in his place in that case a victim may take the role of the injured party as a prosecutor in criminal proceedings.
