Abstract
Ovaj rad se bavi institutom izravne tužbe u okviru obveznih osiguranja u prometu. Institutom izravne tužbe oštećeniku se omogućava da svoj odštetni zahtjev podnese izravno protiv osiguranikova osiguratelja čime mu je pružena veća sigurnost naplate, brže ostvarenje naknade i uspostava prijašnjeg stanja te pojednostavljenje postupka. U radu je prikazan povijesni razvoj navedenoga instituta te njegova povezanost sa propisivanjem obveznih osiguranja, nadalje se razmatra pravna narav osigurateljeve obveze na isplatu osigurnine te podjela između obveznih i dobrovoljnih osiguranja i utjecaj te podjele na pravni položaj oštećenika s obzirom na prigovore kojima se osiguratelj može koristiti protiv njega u odnosu iz izravne tužbe. Rad sadrži prikaz normiranja navedenog instituta u okviru hrvatskog nacionalnog zakonodavstva, važećih međunarodnih pomorskih konvencija, europskih pravnih propisa i primjenu ovoga instituta u okviru klupskih pravila P. & I. klubova.
Abstract (english)
This paper deals with the institute of direct action under complusory traffic insurance. The institute of direct action enables the injured party to submit its claim directly against the insured of the insurer, which has given him greater security charges, faster realization of benefits and establish of the previous situation, and simplification of the procedure. The paper presents the historical development of his institute and its connection with the prescribing of complusory insurance, further discusses the legal nature of insurer's obligation to pay insurance and the division between complusory and voluntary insurance and the impact of division into the leagal position of the injured party in view of the objections that insurer may use against him in relation to the direct action. The paper contains an overview of the standardization of this institute within Croatian national legislation, valid international maritime conventions, European legal regulations and the application of this institute within the club rules of P. & I. clubs.
