Individual labor disputes are disputes in which the employer is on one side, and one or more workers acting as individuals on the other side, and the subject of the dispute is the individual rights and obligations of the parties to the dispute, which arise from employment relationships. The procedure for obtaining legal protection in individual labor disputes in the Republic of Croatia is governed by two laws: the Labor Law and the Civil Procedure Law. The Labor Law contains special rules on the pre-court procedure, deadlines for seeking judicial protection and jurisdiction for labor disputes, and foresees three different ways of achieving legal protection depending on the subject of the dispute and the party initiating it. The Law on Civil Procedure contains general rules on civil procedure as the basic method for resolving civil law disputes in the broadest sense, including labor disputes, and special rules on the procedure in labor disputes. The reason for the special regulation of the procedure in labor disputes, as the Civil Procedure Act calls individual labor disputes, is found in the need for their urgent resolution, the social sensitivity of the issues that are decided in them, and the unequal position in which the worker and the employer as parties to the dispute find themselves . The aim of the paper is to present the current legislative regulation of the rules of procedure in individual labor disputes, their application in practice, and possible improvements de lege ferenda.
