This paper outlays the importance of protecting the institute of property rights. According to property law authorisation, the owner has the right to do as he/she wills with an object and the benefits from it, if this is not contrary to other people's rights and legal restrictions, and, the owner has the right to exclude everyone else from it. Therefore, the owner has the right to protect his/her property rights through property lawsuits, which are: real lawsuit over ownership, actio publiciana property lawsuit, and owner's lawsuit for cessation of disturbance. An actively legitimized person, a passively legitimized person, main and secondary claims, as well as objections and counterclaims of the defendant will all be described for each of these lawsuits. The methods used in writing this paper are: comparative method, method of analysis, method of synthesis and methods of inductive and deductive reasoning. The main goal of this paper is to show the difference amongst lawsuits, as well as the diffe-rence in their application in order to increase the possibility of protection of property rights in the manner prescribed by law.
