This paper work deals with the rights of passengers in rail traffic, that is, the European solutions that regulate it. Passengers' rights refer to damage caused to passengers either by non-fulfillment of the contract such as delay and cancellation of transport, material damage to luggage such as loss and damage, or physical damage - death or bodily injury in the event of an accident. Through two European regulations which arange the matter of passenger rights in rail transport - Regulation (EU) no. 1371/2007 on the rights and obligations of passengers in railway traffic and Regulation (EU) no. 782/2021 on the rights and obligations of passengers in rail transport deals with their rights to travel information, the liability of the carrier for damage caused to passengers, the liability of the rail carrier for delays, cancellation of travel and missed connected journeys, liability for damage caused to luggage, animals and vehicles, rights of passengers with special needs and persons with reduced mobility, the rights of passengers to submit complaints to the carrier and the rights of passengers during the Covid-19 pandemic. The research part of the work refers to a survey that shows the awareness of passengers about their rights and the frequency of using rail transport.
