Abstract
U ovom diplomskom radu analizirala se problematika otkazivanja ugovora o radu, točnije kolektivnog otkazivanja. Kolektivno otkazivanje je otkazivanje ugovora većem broju radnika kod konkretnog poslodavca. Otkazivanje ne nastupa zbog pogreške samih radnika, nego zbog lošeg poslovanja, tehničkih razloga ili pak gospodarske krize. Otkaz uvijek pogađa pojedinca, a u slučaju kolektivnog otkazivanja imamo nekolicinu pojedinaca pa je taj postupak reguliran na drugačiji način. Važnu ulogu u tom postupku imaju radničko vijeće te nadležna javna služba za zapošljavanje. Radi što manjih posljedica na radnike koji su dobili otkaz, ali i društva u cjelini, propisuje se obveze poslodavca nakon što nastupi takva vrsta otkazivanja.
Abstract (english)
In this diploma thesis, the problem of cancellation of employment contracts, more precisely collective cancellation, was analyzed. Collective cancellation is the cancellation of the contract of a large number of workers with a specific employer. Cancellations do not occur because of the workers themselves, but because of bad business, technical reasons or the economic crisis. Cancellation always affects an individual, and in the case of a collective cancellation, we have several individuals, so that procedure is regulated in a different way. An important role in this procedure is played by the workers' council and the competent public employment service. In order to minimize the consequences for the workers who have been dismissed, as well as society as a whole, the employer's obligation is prescribed after this type of dismissal occurs.
