Abstract
Cilj ovog rada je bio opisati posebnu parnicu nazvanu „Postupak zbog smetanja posjeda“. Postupak je specifičan jer se njegove procesne odredbe nalaze u Zakonu o parničnom postupku (koji ga izdvaja u posebnu Glavu Zakona) i u Zakonu o vlasništvu i drugim stvarnim pravima. Rad opisuje tijek postupka uobičajenim redoslijedom počevši od pokretanja tužbe, preko tijeka postupka pa do pravnih lijekova i ovrhe. Detaljno se opisuju pojednini instituti koji razlikuju ovaj postupak od ostalih. Važno je... More naglasiti da se radi o hitnom postupku s ograničenim raspravljanjem čime je cilj da se postupak što prije okonča. Kroz povijest se nije značajnije mijenjao nego ima svoj tijek koji se uglavnom sastoji u preuzimanju odredbi iz prijašnjih propisa. Drugi dio rada se sastoji od sudske prakse koja služi objašnjavanju instituta koji su opisani u prvom dijelu rada. Praksa je obilna jer se radi o jednom od najčešćih postupaka u praksi. Less
Abstract (english)
The purpose of this work was to describe a particular lawsuit titled „Proceedings for interference with possession“. The process i specific because its procedural provisions can be found in the Civil procedure act. (which separates it into a special Chapter of the Law) and in the Property and other thing rights. This paper describes the course of the procedure in the usual order, starting from the initation of a lawsuit, through the course of the proceedings to legal remedies and... More enforcement. Some institutes that distinguish this procedure from others are described in detail. It is important to emphasize that this is an urgent procedure with limited discussion, which aims to end the procedure as soon as possible. Throughout history, it has not changed significantly, but it has its own course, which mainly consists of taking over provisions from previous regulations. The second par of this paper consists of case law that server to explain the institutes described in the first part of the paper.
